Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, have taken possession of the last goods.
To exercise your right of withdrawal, you must inform us (Wunderlich Jewelry, Bornheide 82 in 22549 Hamburg, Germany, gems4u.eu@public-files.de) by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, which is not mandatory. You can also declare your withdrawal via our electronic withdrawal form under "Withdraw from contract" in the footer menu on our website. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of Withdrawal
If you withdraw from this contract, we must repay you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract was received by us. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without undue delay and in any case at the latest within fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You bear the direct costs of returning the goods. Since the risk of return shipment lies with you, we expressly recommend using an insured courier service. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functionality of the goods. Note: The costs for the parcel shipment depend on the place of dispatch, the packaging, the weight and the declared value of the shipment. For example, on the UPS website at http://www.ups.com, it is possible to calculate the costs for returns.
Customized or engraved products as well as custom-made products at the customer's request are excluded from the right of withdrawal.
§ 10 Retention of Title
The delivered goods remain our property until full payment of the purchase price.
§ 11 Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all legal disputes arising from this contract is Bad Homburg if the customer is a merchant within the meaning of the German Commercial Code, a person without a fixed domicile in Germany, has relocated their domicile abroad, or the customer's domicile is unknown at the time of the lawsuit. Should one or more clauses of these terms and conditions be wholly or partially invalid, the validity of the remaining provisions shall not be affected thereby.
The legislator provides the following sample withdrawal form in Annex 2 to Article 246a § 1 Section 2 Sentence 1 Number 1 and § 2 Section 2 Number 2 EGBGB:
