Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last goods.
To exercise your right of withdrawal, you must inform us (Wunderlich Jewelry, Bornheide 82, 22549 Hamburg, Germany, gems4u.eu@public-files.de ) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but this is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of the revocation
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods. As the risk of return shipping lies with you, we expressly recommend using an insured courier service. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Note: The costs for parcel shipping depend on the point of origin, the packaging, the weight, and the declared value of the shipment. For example, you can calculate return shipping costs on the UPS website at http://www.ups.com.
Individualized or engraved products, as well as custom-made items at the customer's request, are excluded from the right of withdrawal.
§ 10 Retention of Title
The delivered goods remain our property until the purchase price has been paid in full.
§ 11 Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all legal disputes arising from this contract is Bad Homburg, provided the customer is a merchant as defined by the German Commercial Code (HGB), a person without a fixed residence in Germany, has moved their residence abroad, or the customer's residence is unknown at the time the action is brought. Should one or more clauses of these terms and conditions be wholly or partially invalid, the validity of the remaining provisions shall not be affected.
The legislator provides the following model withdrawal form in Annex 2 to Article 246a § 1 paragraph 2 sentence 1 number 1 and § 2 paragraph 2 number 2 of the Introductory Act to the German Civil Code (EGBGB):
